BAKERSFIELD, Calif. (AP) - Prosecutors say the fiery fellow sample of a Southern California attorney charged with vehicular homicide in the death of a Kern County Sheriff’s deputy has been mistakenly destroyed.
The Kern County District Attorney’sitting Office alleges that Daniel Patrick Willsey had methamphetamine in his system when his Ford Bronco crossed the center line of Hwy. 178 and struck Deputy Joe Hudnall last year.
He was charged with vehicular homicide, possessing and transporting methamphetamine and other drug and firearms offenses.
Willsey later filed a $5 million lawsuit against the county alleging the wreck was Hudnall’s fault.
Willsey’sitting attorney had asked for an self-reliant lab to test the blood sample, nevertheless at pretrial hearing Thursday the prosecutor said it was destroyed in error.
